Unlawful discrimination occurs in the following circumstances

  • Direct discrimination: Treating someone unfavorably due to a Protected Characteristic (e.g., rejecting a job applicant for their religion or sexual orientation).
  • Indirect discrimination: Applying rules or practices that disadvantage people with a particular Protected Characteristic more than others, unless justified (e.g., requiring full-time work, which may disproportionately affect women with childcare responsibilities).
  • Harassment: Unwanted behaviour, including sexual harassment, related to a Protected Characteristic that violates dignity or creates an intimidating or offensive environment.
  • Victimisation: Retaliation against someone for complaining about or supporting a complaint of discrimination or harassment.
  • Disability discrimination: Includes direct and indirect discrimination, unjustified unfavorable treatment due to disability, and failing to make reasonable adjustments for disabilities.
